» Wanting to unpick art inspirations

I want to start using variety in my my blog so that I can share my inspirations behind my photography, and hopefully engage some discussion with my blog readers (e.g they can suggest further works connected with the images I upload.) These could include postcard images, images from books, websites and even adverts. However, would I be violating their copyright in uploading digital images of artworks from these sources? Can anyone help me on this one?

As long as you give credit
to the source image…
and are not making money from it…
there is not much anyone will
come after you for…
and as artists..
we all live from reference-inspired creativity… nothing is new…
everything is new again…
I would love to see your reference…

There will be as many answers as countries around the globe ;-), so I can tell you how is it like in Poland (similar to all other EU countries). If you copy from a website you can just put on your site link to a place where did you take it from, because it’s already public and you don’t take money from this. It’s more complex with books and postcards (to read, see the book you have to pay for it). The easiest solution is to ask an author for permission. You will not, of course, do any harm to anyone but it’s nice to be on right side of the law ;).

I’m not sure on the technical legalities, but if you are not making money from this blog, and if you acknowledge the sources of the imagery, then my feeling is that it would be ok. It would be even better if you could somehow protect the images from being copied from your site…
In terms of the idea though, I think it is fantastic, and would provide a powerful insight into your artistic process.

Most published images require written permission unless old , public domain or otherwise stated in the work.

Well, as far as I know it is a violation of rights to use other people images without their permission… But I am not a lawyer. But, to be honest, as long as you are doing it for purely personal reasons (like engaging the discussion) I would not be too concerned. After all, you are not using it to earn any money, and so on.
For example, there are many marketing web sites showing various adverts for the purpose of case study or pure gallery stuff and nobody’s bothered…
And I am always opened for discussion. (Not @ 4:17 at night though, I have a night shift today, so please don’t get used

In Australia, as with most countries i am sure, technically it is illegal to post published work without the permission of the original author/copyright holder. Generally as a rule if the work is being used as a reference material and is not making any commercial gain then the only legal claim they can make of you is to remove their work (as lon as their work is not being slandered or if it bothers them that much). My experience is that most authors as long as they are credited are quite happy as it is exposure for them, (especially fringe artists) however on the other foot it’s always polite to ask. My rule would be - if the reference author has a history of being touchy on copyright - ask, if not reference away. Am sure with the quality of work you are producing most reference authors would be more than happy being associated with you.

Thanks alot for the feedback. The general consensus I am getting here is that I should always ask if possible, and state the source. And if I can’t ask, then to state the source clearly and, well, hope for the best
I will also be as polite as possible…

There’ll be fascinating insights. The references you see in your work will not always be those seen by your correspondents.
For instance, I see a bit of Alma Tadema on occasion. May you have the success he enjoyed!

From spanish law you can do it, but I recommend you to ask for permission before, because the trades can make an efford on demanding you and sometimes is more a waste of time than a problem because if you don´t earn money because of it… However, you will make them earn money

Hi Aniela, I love what you do with photography. I am a U.K artist too with a website and a blog. With blogging I try to credit as much as possible and I’m a bit reluctant to add proper artist work without it. But once people put images on the web it’s going to be downloaded one way or another, and I feel that as long as my own images carry the web address I’m always going to get a credit. Most people who try to protect their images are doing it for commercial reasons anyway, but others should feel that copying for pleasure is a form of compliment and endorsment of talent.

Explaining own artifices is a waste of precious time and only the boring minds will want to know…Personalmente that the comments of this image oscillate between Mexico and a victorian England is proof of the universal attraction of the personas you create…Quoiting badly Rumi,visuals artists are sellers of mirrors in cities of blinds…Sell the mirror…and if the buyer regain sight…call it magic,or miracle…
